1. Acceptance of Terms
By accessing, browsing, or initiating a transaction on botanistseeds.com (the “Site”), you (“the User” or “Customer”) formally enter into a legally binding agreement and signify your irrevocable consent to these Terms and Conditions, our Privacy Policy, and our Legal Disclaimer. These Terms do not supersede any statutory rights granted to you under applicable consumer protection laws that cannot be excluded by contract.
2. Eligibility and Age Requirements
Access to this Site and the purchase of any products are strictly reserved for individuals aged 21 years or older in the United States, or the age of majority in the User’s respective country of residence. By using this Site, you represent and warrant that you meet these age requirements.
3. Purpose of Products and Legal Compliance
- 3.1 Souvenir Status: All seeds are offered exclusively as collectible, adult souvenirs for the purpose of genetic preservation.
- 3.2 Non-Germination Policy: Seeds are not intended for planting, reproduction, or transformation. Botanist Seeds does not condone the illegal use, growth, or supply of controlled substances.
- 3.3 Regional Laws: It is the Customer’s absolute responsibility to comply with the laws of their specific region. The Company assumes no liability for products seized or intercepted due to local legal restrictions.
4. Statutory Classification (2018 Farm Bill & H.R. 5371)
- 4.1 Federal Definition: All products consist of organic material that falls within the federal definition of “hemp” under 7 U.S.C. § 1639o.
- 4.2 Total THC Standards: In accordance with the Continuing Appropriations Act of 2026 (H.R. 5371), the Company acknowledges the federal shift toward a “Total THC” standard. We are currently operating within the federal grace period concluding on November 12, 2026.
- 4.3 Post-2026 Compliance: Users are advised that federal protections for certain genetics may change after the 2026 deadline. Continued possession of these items after said date is at the User’s own legal risk.
5. Intellectual Property and Asset Protection
The intellectual property rights of this Site—including but not limited to source code, navigation structure, database architecture, proprietary seed photography, and curated genetic descriptions—remain the exclusive property of Botanist Seeds.
- Prohibited Extraction: Any unauthorized “scraping,” data mining, or automated extraction of Site data for commercial purposes is strictly prohibited.
- Enforcement: Any infringement, including the reproduction of our proprietary genetic profiles or visual media without express written authorization, will be prosecuted to the fullest extent of the law.
6. Limitation of Liability
- 6.1 Site Availability: The Site is provided on an “as available” basis. We do not warrant that the Site will be uninterrupted or error-free.
- 6.2 Technical Anomalies: Botanist Seeds shall not be held liable for delays or impossibility of order confirmation resulting from internet network anomalies, browser malfunctions, or the use of outdated software by the Customer.
- 6.3 FDA Disclaimer: Statements on this Site have not been evaluated by the FDA and are not intended to diagnose, treat, or prevent any disease.
7. Bad Faith Utilization and Indemnification
Botanist Seeds reserves the unilateral right to terminate any transaction, refuse service, or disable a User account if it determines, at its sole discretion, that the Site or its products are being utilized in bad faith.
- Scope of Bad Faith: This includes, but is not limited to, fraudulent acquisition of rewards, exploitation of technical errors, or use of the Site in a manner that causes reputational or technical damage to the Company.
- Indemnification: The User agrees to indemnify and hold harmless Botanist Seeds from any and all third-party claims, liabilities, or costs arising from the User’s breach of these terms.
8. Force Majeure

Infrastructure & Tech: Widespread internet service provider (ISP) outages, large-scale distributed denial-of-service (DDoS) attacks, or catastrophic failure of third-party cloud hosting services (e.g., AWS, Azure, Google Cloud).

Supply & Logistics: Global or regional shortages of raw materials, sudden port closures, or nationalized grounding of major commercial shipping carriers.

External Forces: Acts of God (fire, flood, earthquake), pandemics, war, terrorism, civil unrest, or changes in government regulations/trade embargos that make the sale or shipment of goods illegal.
